How long does the marriage sponsorship process take?
The average processing time can vary but typically ranges from 12 to 18 months, depending on your unique situation and the completeness of your application.
What type of proof is required to show my marriage is genuine?
You should include official documents (like a marriage certificate), joint financial statements, photos, travel records, communication logs, and letters from family and friends that demonstrate your relationship is real and ongoing.
Can my spouse work in Canada while we wait for a decision?
If your spouse is applying from within Canada (In-Canada Class), they may be eligible for an open work permit while their sponsorship application is being processed.
What happens if my application is refused?
If your sponsorship application is refused, you will receive a detailed decision letter. Outland applicants have the right to appeal. Consider seeking legal advice to understand your options for appeal or re-application.
Is there a financial requirement to sponsor my spouse?
While there is no set minimum income requirement for spousal sponsorship, you must sign an undertaking to support your spouse’s basic needs and prove you are not receiving social assistance (except for disability).
Can I sponsor my spouse if I am living outside Canada?
Canadian citizens living abroad may sponsor their spouse, provided they can show they plan to return and live in Canada when their spouse becomes a permanent resident. Permanent residents must be residing in Canada to sponsor.
PGP
Is the Parents and Grandparents Program (PGP) currently open for new applications?
No, as of early 2026, the PGP intake is closed to new expressions of interest. Future intakes have not been announced by IRCC.
What are the key eligibility criteria for sponsoring parents or grandparents?
You must be at least 18, be a Canadian citizen or permanent resident, reside in Canada, and meet the Minimum Necessary Income (MNI) for the last three years.
How does the PGP selection process work?
IRCC randomly selects candidates from the existing pool of sponsors who submitted an “Interest to Sponsor” form during the last intake.
What financial commitment is required for PGP sponsorship?
Sponsors must commit to supporting their parents and grandparents for 20 years (10 years in Quebec), including all basic needs and social assistance repayment.
Can I sponsor my parents or grandparents if I haven’t been selected for the PGP?
While you cannot submit a new PGP application, the Super Visa is an excellent alternative for temporary stays with multiple entries.
What documents will I need if I am selected to apply through the PGP?
Required documents include proof of income (NOAs from CRA), relationship documents, government-issued IDs, and supporting forms. Additional evidence may be needed by IRCC.
How can an immigration consultant assist me with the PGP or Super Visa process?
A regulated immigration consultant provides step-by-step guidance, ensures you meet all requirements, helps you assemble accurate documentation, and keeps you informed about program changes. This support can reduce errors and bring peace of mind to your family sponsorship journey.
H&C
Who can apply for a Humanitarian and Compassionate (H&C) application?
Individuals inside Canada who are not eligible for permanent residence through other channels and would face unusual, undeserved, or disproportionate hardship if required to leave can apply.
What factors does an immigration officer consider in H&C cases?
Officers look at your establishment in Canada, the best interests of any children involved, and specific hardships you would face if removed from Canada, among other individual circumstances.
How long does the H&C application process take?
Processing times vary, but it is common for H&C applications to take several months to a couple of years, depending on case complexity and IRCC workload.
Can I include my family members in my H&C application?
In most cases, you can include immediate family members who are in Canada with you. Each case is unique, so it’s essential to consult with an immigration expert.
Will submitting an H&C application stop my removal from Canada?
Submitting an H&C application does not automatically stop removal proceedings. You may be able to request a stay of removal in certain situations, but legal guidance is recommended.
Can I appeal a refusal of my H&C application?
There is no right to appeal a negative H&C decision to the Immigration Appeal Division, but you can seek judicial review at the Federal Court.
